1. Agreement & Legal Operator Entity

Welcome to Hosting Setu (hostingsetu.com). By accessing our website or purchasing any of our infrastructure services, you enter into a legally binding agreement with NetVantage Systems Private Limited, a subsidiary of Apex Info Sys Solutions.

2. Website Usage & Acceptance

By browsing this site or subscribing to any Hosting Setu services (including web hosting, cloud VPS, dedicated servers, domain names, business email, SSL certificates, or website development), you represent that you are at least 18 years of age and legally authorized to enter into binding contracts on behalf of yourself or your organization.

3. Description of Services & Products

Hosting Setu provides digital infrastructure services including but not limited to:

• Web & Shared Hosting: Shared Linux/Windows web hosting, WordPress hosting, WooCommerce hosting, and Reseller plans.
• Cloud & Enterprise Infrastructure: Virtual Private Servers (VPS), Dedicated Cloud Servers, Kubernetes management, and DevOps stacks.
• Domain & Identity: Domain name registration (.COM, .IN, and global TLDs), DNS management, WHOIS privacy, and SSL/BIMI security.
• Business Email & Productivity: Business email setups (Google Workspace, Microsoft 365, Zoho Mail, Titan Mail) and high-deliverability SMTP services.

4. User & Account Responsibilities

Users are responsible for:

• Maintaining accurate and current account billing and WHOIS domain contact information.
• Safeguarding login credentials and administrative access keys.
• Maintaining local backups of all website content, databases, and mailbox files stored on our servers.

5. Acceptable Use Policy & Prohibited Activities

Hosting Setu infrastructure must not be used for illegal or malicious activities, including:

• Transmission of unsolicited commercial email (SPAM), phishing campaigns, or open relay mail operations.
• Hosting or distributing malware, trojans, ransomware, or executing Distributed Denial of Service (DDoS) attacks.
• Hosting copyright-infringing content, counterfeit software, or unlawful materials.
• Attempting unauthorized access to neighboring tenant accounts or system kernels.

6. Payments, Billing & Renewals

Services are billed in advance on a recurring subscription basis (monthly, annual, or multi-year terms depending on the plan selected).

• Domain name renewals must be paid prior to expiration date to prevent registry redemption penalties.
• Invoices unpaid past the due date may result in automated service suspension and eventual data deletion.

7. Refund & Cancellation Policy

Hosting Setu operates transparent refund and cancellation procedures in accordance with service tier specifications:

• Shared Web Hosting: Eligible for standard money-back guarantee within the initial trial period, excluding setup fees.
• Domain Names: Non-refundable once registered with external registries (ICANN / NIXI) as registry fees are consumed immediately.
• Dedicated & Enterprise Cloud: Custom setup fees and dedicated hardware provisions are non-refundable.

8. Intellectual Property Rights

All website graphics, logos, text, design elements, and source code associated with Hosting Setu are the property of NetVantage Systems Private Limited or its parent company Apex Info Sys Solutions. Users retain full ownership of all proprietary data, text, and media uploaded to their hosted accounts.

9. Service Availability & SLA

While Hosting Setu strives for 99.9% network uptime across its cloud platforms, scheduled maintenance, upstream telecommunication failures, or emergency security patching may cause intermittent downtime. Planned maintenance windows are communicated in advance whenever feasible.

10. Limitation of Liability & Disclaimer

To the maximum extent permitted by applicable law, NetVantage Systems Private Limited, its parent Apex Info Sys Solutions, officers, and directors shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or business interruption arising from server downtime or service usage.

11. Termination

We reserve the right to suspend or terminate service accounts immediately without prior notice upon detection of severe Acceptable Use Policy violations, fraud, or abuse.

12. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any legal disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent Courts of Coimbatore, Tamil Nadu, India.

13. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of Hosting Setu after revisions are published constitutes binding acceptance of the updated terms.
